Terms of Service
Version 0.1 (beta) · Effective: July 8, 2026 · Provider: Prompt Purge LLC, a California limited liability company, 12090 Helga Ln., Moreno Valley, CA 92555, USA, which operates the Obskur AI service ("Obskur AI", "we", "us"). Contact: legal@obskur.ai.
These Terms are a beta version under review by counsel. If we change them materially, we will tell you before the change takes effect (see section 13).
By creating an account or using the hosted Obskur AI service (the "Service"), you ("Customer", "you") agree to these Terms. If you use the Service for an organisation, you represent that you may bind it.
1. The Service
Obskur AI is a privacy-first AI chat gateway. Text you enter is processed by an in-browser redaction step that replaces detected personal data with placeholders before it is transmitted; the redacted text is then relayed to the AI model provider you select. We also offer a server-side Redaction API, a separate data-processing feature. Business customers can request our Data Processing Addendum. Some features are marked beta on our pricing page, including single sign-on and the browser extension. Features vary by plan.
2. Accounts & eligibility
You must provide accurate registration details, keep credentials secure, and are responsible for activity under your account. You must be 18 or older and able to form a contract. One human owner administers each organisation workspace.
3. Acceptable use
You will not: (a) break the law or infringe others' rights; (b) upload content you lack the right to process; (c) attempt to access other customers' data or circumvent the workspace isolation, redaction, or access controls; (d) reverse-engineer, scrape, or redistribute the proprietary models or Service (the separately licensed AGPLv3 edition is the exception, under its own licence); (e) resell or provide the Service to third parties except as your own end-users under your account; (f) use it to generate unlawful, harmful, or abusive content, or to violate a model provider's terms.
4. Customer data & the redaction boundary
- You own your content. We process it to provide the Service. Handling of personal data is described in the Privacy Notice and, for business customers, in our Data Processing Addendum, available on request.
- Redaction is best-effort, not a guarantee. The in-browser filter is designed to minimise the personal data transmitted, but it is not perfect, can be disabled or bypassed, and may miss data. You remain responsible for what you submit and for your own legal obligations regarding it. Do not rely on redaction as your sole control for regulated data unless your own assessment supports it.
- Third-party model providers. When you send a prompt, the redacted text is transmitted to the AI provider you choose, under their terms. We are not responsible for their processing or outputs.
- AI output disclaimer. Model outputs may be inaccurate; you are responsible for evaluating them. The Service is not professional (legal, medical, financial) advice.
5. Plans, fees, billing
Paid plans are billed through Stripe on the cycle shown at checkout. Fees are exclusive of taxes. Subscriptions renew automatically until cancelled. Cancelling stops future renewals; fees already paid are not refunded for partial periods, except where the law requires a refund. We may change pricing on 30 days' notice, effective from your next billing cycle. Non-payment may suspend or downgrade access.
6. Data retention on the hosted service
Conversation retention is customer-configurable (default 90 days, with an optional "store indefinitely" setting). If an organisation's subscription lapses, indefinitely stored conversations may be deleted 30 days after the subscription ends; see the Privacy Notice. Export your data before cancelling if you need it.
7. Intellectual property
We (and our licensors) own the Service, the proprietary models, and all related intellectual property. These Terms grant no rights to them except to use the hosted Service under your plan. The open-source edition is licensed separately under the AGPLv3. We may use feedback you give us without obligation.
8. Confidentiality; security
Each party protects the other's non-public information. We apply the technical and organisational security measures described in the Privacy Notice. No security is perfect; we do not warrant that the Service is uninterrupted or error-free.
9. Warranties & disclaimers
The Service is provided "as is" and "as available" to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain exclusions, so some of them may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) each party's total liability arising out of these Terms is limited to the greater of the fees you paid us in the 12 months before the claim arose, or US$100. These limits do not apply where the law does not allow them to, including for fraud, gross negligence, or wilful misconduct.
11. Indemnity
You will indemnify us against third-party claims arising from your content or your breach of these Terms, subject to the limits in section 10.
12. Suspension & termination
Either party may terminate for a material breach that remains uncured 30 days after notice. We may suspend access immediately for security, legal risk, or non-payment. On termination your access ends, and we delete or return your data as described in the Privacy Notice and your retention settings.
13. Changes to these Terms
We may update these Terms; material changes take effect 30 days after we notify you by email or in the app. Continuing to use the Service after that date is acceptance. Each version is dated, and superseded versions are kept on request.
14. Governing law & disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Riverside County, California have exclusive jurisdiction, except that nothing here removes protections a consumer has under the mandatory law of the country where they live.
15. General
These Terms, the Privacy Notice, any Data Processing Addendum or Business Associate Agreement you sign with us, and your plan's description form the entire agreement. A failure to enforce a term is not a waiver. If a term is unenforceable, the rest remain in effect. You may not assign these Terms without our consent, except to a successor of your business; notices go to the contacts above.
